Terms of Sale
Every account must be prepared to supply valid business credentials upon request. All prices, minimums, and measurements are subject to change. Fabric and colors may vary. Size is approximate. Please remember that all product is custom made or handmade and therefore variations are to be expected. Your order is subject to Muppin Incorporated(also known herein as Muppin Inc.)’s Terms of Sale in effect at the time your order is placed. Muppin Inc. may modify these Terms of Sale without prior notice. All orders must be prepaid before shipment.
A ten piece minimum is required on all wholesale orders. Muppin Inc.’s minimums to manufacture are 25. Any orders under this minimum will be held until this manufacture quantity is met.
Muppin Inc. accepts Visa, Master Card, American Express and Discover. Your credit card will be charged the actual invoice amount plus shipping & handling on the day that we ship your order. If your credit card is declined, we will notify you by phone or email. Please contact us with your updated credit card information so that we may process your order in a timely manner.
Checks presented for payment to Muppin Inc. will be subject to a $50 administration fee if returned. Orders will not ship until checks have cleared.
Shipping & Handling Costs
The customer is responsible for all shipping & handling costs. We ship via USPS unless requested otherwise. All items are shipped FOB Plainfield, Illinois.
Claims and Returns
Please inspect your shipment upon receipt for shipping damage and for correct style, color, size and quantity. Shipping damage claims must be made within 3 business days of receipt. Defective product claims must be made within 7 days from the invoice date. The restocking and freight charges may not apply to defective products, as determined solely by Muppin.com.
All original cartons, packing materials, and tracking labels must be saved until the claim is settled. We will require a digital photo for all claims made on defective merchandise to be sent to: email@example.com. Once a claim has been processed, replacements, refunds or credit will be issued.
A 35% restocking fee plus applicable shipping charges will be assessed on any order refused or returned without prior authorization. A return authorization number will be issued for any items that we allow to be returned. This number should be put on the outside of the box as well as a copy of the invoice. Remember that all items must be in their original carton, inner packing, and not priced to receive credit.
PLEASE NOTE: All order sales are final; no returns or exchanges can or will be made.
Should a past due account need to be placed in with a collection agency, all collection costs are the sole responsibility of the customer. This includes all finance charges, and any and all collection costs including, but not limited to, attorney’s fees.
You may cancel your order within 24 hours from receipt of your order confirmation. After that, order cancellation is at Muppin Inc.’s sole discretion.
Revisions to Orders
Any revision to an order must be sent in writing to Muppin Inc. within 24 hours of submission of original order. Thereafter, the order will be automatically released for processing and not available for revision. Any additions made to a PO on the days following the order will be processed as a new order. It is Muppin Inc.’s policy not to cancel or add items to a shipment once the order is packed, however, if changes to a shipment that has already been packed are unavoidable, a 15% re-stocking fee will be applied to your account.
Limitation of Liability
EXCEPT FOR THE WARRANTY SET FORTH ABOVE, MUPPIN INC. DISCLAIMS ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT WILL MUPPIN INC. BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES RESULTING FROM YOUR PURCHASE, EVEN IF MUPPIN INC. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. MUPPIN INC.’S ENTIRE LIABILITY FOR ANY PRODUCT SALE WILL NOT EXCEED THE TOTAL AMOUNT ACTUALLY RECEIVED BY MUPPIN INC. FROM SUCH SALE.
Muppin Inc. designs are registered copyright of Cheryl Sleboda. Your product order does not authorize you to reproduce, resell or otherwise use Muppin Inc.’s product designs and materials other than for its specific purpose. You may not incorporate Muppin Inc. products in manufactured items for resale without Muppin Inc.’s prior written consent and pursuant to a written license. Muppin Inc. reserves the right to refuse orders that do not meet these criteria. All materials, photos, logos, designs, images whether a part of our catalog or website are the sole property of Muppin Inc. and cannot be scanned, published, reproduced or distributed in whole or in part without the written approval of Muppin Inc..
Waiver and Severability
Muppin Inc.’s failure to exercise or enforce any Term of Sale will not constitute a waiver of these. If any Term of Sale is held to be unenforceable, all other Terms of Sale will remain in effect.
These Terms of Sale are governed by Illinois law, without regard to its conflict of law principles. You agree to submit to the jurisdiction of the courts of Will County, Illinois.
